$6.25 million settlement achieved against an Adventure Park in a wrongful death case involving Massachusetts woman

Marasco & Nesselbush, LLP, a leading injury law firm whose practice is focused on catastrophic injuries, secured a $6.25 million settlement against an adventure park in a case that resulted in the death of a 51-year-old Massachusetts woman.

Marasco & Nesselbush attorney Tom Moran, represented the victim’s husband who filed suit on behalf of his late wife’s estate in 2023. The Massachusetts couple were vacationing in South Carolina in July 2021 when they visited an adventure park.

The decedent and her husband were making their way to the park entrance when she tripped and fell on un-repaired asphalt, resulting in multiple head and facial injuries. Doctors diagnosed a brain injury, requiring a series of medical interventions including an embolization procedure and extensive physical therapy. As a result of the injuries, she experienced seizures and other serious health challenges which led to her death several months after the accident.

M&N retained a team of experts who inspected the accident site and confirmed that the un-repaired asphalt directly led to our client’s fall. Medical experts retained by M&N also testified that the injuries sustained in the fall directly caused the follow up medical challenges that led to our client’s death.
