On March 9th, North Providence Doctor Jerrold N. Rosenberg was sentenced to 51 months in federal prison on charges of health care fraud, conspiracy to solicit or accept kickbacks, and receipt of kickbacks from the drug company Insys Therapeutics.

Insys Therapeutics is the manufacturer of Subsys – a highly potent, highly addictive sublingual spray version of the opioid painkiller drug Fentanyl. The founder and majority shareholder of Insys Therapeutics was charged late last year with fraud and with leading a nationwide conspiracy to profit illegally by offering doctors bribes and kickbacks to prescribe their drug.

The FDA approved Subsys in 2012 “for the management of breakthrough pain in adult cancer patients who are already receiving and who are tolerant to around-the-clock opioid therapy for their underlying persistent cancer pain.” In other words, this dangerous and highly addictive drug was intended to be prescribed only to treat pain in cancer patients who were unresponsive to safer versions of opioid painkillers.

A jury found Dr. Rosenberg guilty of accepting these bribes and kickbacks from the company and of prescribing the drug Subsys for off-label purposes. 

Daisy Medina, one of the victims of this heinous greed, told the court at Rosenberg’s sentencing, “I’m very upset that they keep calling him a doctor — a doctor makes an oath … I never touched drugs. He made me a junkie.” Medina went on to report that when she asked Rosenberg to help her get off the drug, he told her to “stop being a baby”.
