Social Security Disability Attorneys Serving Rhode Island, Connecticut and Massachusetts
Marasco & Nesselbush, LLP, has a team of experienced Social Security disability lawyers who work diligently to protect the rights of our clients and help them obtain the disability benefits they need and deserve. We serve Rhode Island, Connecticut and Massachusetts.
With years of experience representing thousands of Social Security disability (SSD) claimants, we work with your doctors and our medical experts to obtain the appropriate medical evidence necessary to support your disability claim and build a compelling disability case that will be approved.
Our SSD attorneys work tirelessly to develop the strongest possible strategy to win your claim. We always tell our clients, “If you are denied, don’t give up.” Social Security denies many deserving and truly disabled claimants. At Marasco & Nesselbush, we will stand by your side and continue to appeal your claim until justice is done. We may even be able to expedite your claim with the Social Security Administration (SSA) if you meet certain eligibility criteria.
Types of Social Security Benefits: SSDI & SSI
The Social Security Administration provides disability payments under two programs:
- Social Security Disability Insurance (SSDI) is for people who have amassed a substantial work history before they became unable to work due to a disability. SSDI can provide monthly cash benefits, Medicare health insurance, and Medicare Part D prescription coverage to those who qualify. Some family benefits are possible, and claimants may receive retroactive benefits when they are approved for SSDI.
- Supplemental Security Income (SSI) is for people who have not worked substantially, for whatever reason: either they were not well enough to work, or they were taking care of children, etc. SSI can provide monthly cash benefits as well as Medicaid health benefits with prescription coverage to qualified individuals. Eligibility is linked to household income. Retroactive benefits are possible but only as of the month after application. There are no family benefits available through SSI.
The Social Security Administration has its own language that can be complicated and confusing. Our experienced legal team understands the terms, concepts, and definitions used by Social Security, and that’s why we are able to prove your claim and ensure you receive the correct amount of retroactive and monthly benefits.
Social Security Disability Benefits in High Demand
According to the SSA, a 20-year-old worker has a 30 percent chance of becoming disabled before he or she reaches retirement age.
The SSA has specific criteria as to what constitutes a qualifying “disability.” This means that the application and appeals processes can appear very complex, technical, and demanding. We have decades of experience helping individuals with disabilities receive full SSD benefits, and we are well versed in the evidentiary requirements that make the difference between winning and losing, approval and rejection.
You are not required to hire an attorney to find out how to apply for Social Security disability benefits, however, hiring a knowledgeable and experienced attorney who focuses in this field of law can greatly increase your chances of winning.
The Benefit of Hiring A Social Security Disability Attorney
Our Social Security Disability law firm is extremely helpful and successful in obtaining Social Security benefits for claimants with disabilities. They can make sure that your application includes extensive treatment records for qualifying physical and/or mental health conditions in addition to detailed and appropriate documentation of your history, symptoms, and functional limitations. National statistics show that claimants with legal representation have a substantially greater likelihood of receiving an award of disability benefits than claimants who proceed without an attorney.
Applying for Social Security Disability benefits without an attorney can be a difficult, daunting and overwhelming process. A missed deadline may mean that you have to start the process over again. A missed deadline or unfavorable decision after your “date last insured” has expired may mean that you are forever precluded from applying again. Do not let this happen to you. Don’t become a victim of the system.
The skilled lawyers at Marasco & Nesselbush can and will ease your way during the application and appeal processes. Whether you live in RI or MA, we at Marasco & Nesselbush have developed effective strategies to obtain important medical opinion evidence to support your disability claim. When we represent you, we will communicate with your physician(s) to obtain helpful medical and legal evidence of your disability. Over the years, we have developed valuable physician questionnaires to enable your doctor(s) to meaningfully and easily support your claim for SSI or SSDI benefits. We will advise you regarding the application process, we will appeal a denial, if any, we will review your case to determine if you qualify for an expedited decision, we will prepare you and accompany you to your hearing before the Administrative Law Judge and, once approved, our lawyers will continue to advocate for you until you receive your retroactive and monthly benefits. Without Marasco & Nesselbush, you may be unnecessarily denied your social security benefits, your case may take longer than it needs to, or you may not receive all the benefits to which you are legally entitled. Do not let any of these things happen to you. Call us today for a free consultation. We make the difference.
We charge no fee unless and until we win your case and obtain Social Security Disability benefits for you. When we win, our fee is twenty-five percent (25%) of retroactive benefits. The Social Security Administration will automatically withhold our twenty-five percent (25%) fee, and will send you the remaining seventy-five percent (75%) of your retroactive benefits. You, the claimant, will then begin receiving your full, monthly Social Security Disability check(s) each month, into the future, with absolutely no additional fees to Marasco & Nesselbush.
Our fee is a one-time payment, made automatically by the Social Security Administration, of 25% of your retroactive benefits. There may also be a cost to obtain medical evidence supporting your claim. Costs for obtaining your medical records are generally low and are different from legal fees for doing the legal work on your case. Marasco & Nesselbush always tries to obtain medical evidence for either no cost or for as low a cost to you as possible.
