Accident Results in $1.25 Million Recovery

Partner Joe Marasco and associate Attorney Thomas Moran achieved a one million two hundred and fifty-thousand-dollar policy limit recovery on behalf of our client who sustained a traumatic brain injury. Our nineteen- year-old client was a passenger in a negligently operated car. The driver was operating at a high rate of speed and lost control of the car causing it to leave the road, crashing into a guardrail. 

The firm assembled a team of investigators and trusted medical experts to establish the cause of the accident, identify available sources of recovery and ultimately to establish the extent of the client’s injuries. During the representation the firm hired an expert, a doctor who focusses on treatment of brain injuries. A neuro-cognitive evaluation was performed which established the long-term impact of the injury. 

The Superior Court litigation was concluded within one year and resulted in a settlement which is designed to provide financial security to the young client for life. As part of the wholistic approach to providing legal care the firm engaged probate attorneys to assist with the establishment of a guardianship estate and trust instruments designed to ensure that the injured client will receive financial security through a structured settlement and trust.
