The United States First Circuit Court of Appeals Awards 30 Years of Past Social Security Disability Benefits to Rhode Island Widow

This unwavering commitment is emphasized by a recent, and major, United States First Circuit Court of Appeals win for a Rhode Island widow, Cecelia Frusher, who was awarded thirty years of retroactive Social Security Disability benefits. The successful case result came 36 years after the date of Dr. Richard Frusher's initial application for Social Security Disability benefits and six years of litigation.
At the root of the Social Security Disability appeals case was the claim that Dr. Frusher's schizophrenia was good cause pursuant to SSR 91-5p for his failure to appeal to the Social Security Administration (SSA) denials in 1975 and 1978. In consulting with Mrs. Frusher and helping her pursue the case after her husband's death, Donna M. Nesselbush's firm belief in the law and her determination to have justice served made the case successful. Attorney Nesselbush stated, “The appeals process is lengthy and strictly regulated, but at the end of the day, if a claimant is too ill to appeal an unfavorable ruling, he or she is entitled to special consideration under Social Security's regulations.”
